But is it a fruit or a vegetable? A U.S. Supreme Court case of Nix vs. Hedden (1893) decided 'Tomatoes are "vegetables" and not "fruit" within the meaning of the Tariff Act of 1883 based on the common meaning of those words'. The court ruled that the tomato was a vegetable in its function because it is served in salads, soups, and main courses. Only if it was eaten in hand or in a dessert can it be classified as a fruit. I believe the fruit/vegetable debate still goes on.
